Terms of Business (Service)
1. Any contract made with the company is subject to these terms unless
these terms are excluded or varied by express written agreement made
by the company and the customer, any conflicting terms of business
of the customer shall have no effect.
2. The company shall carry out servicing of the equipment specified
overleaf and the customer shall pay to the company the price of
all materials and component parts used together with the charges
based on the time spent by the companies engineer on the service
and in travelling.
3. If any service charge payable hereunder or any part thereof
shall be unpaid fourteen days after the same shall have been due
the company shall be entitled (without prejudice to any other remedy)
to deduct all or part of the amount due from any amount owed by
the company to the customer.
4. All work carried out under this contract shall be to the highest
standards and carried out by competent engineers and all materials
and component parts supplied or used shall be obtained from suppliers
of repute.
5. Before any machine is serviced by the companies engineer, it
must be correctly and permanently wired to the main supply. The
companies engineers have strict instructions not to service machines
with temporary or sub-standard wiring conditions.
6. The company shall be liable for any loss damage injury or delay
due to any cause beyond its control.
7. The company shall be liable for death or personal injury resulting
from its negligence.
8. Save as is herein before provided any express or implied conditions
statement or warranty (whether arising by stature or otherwise) in
respect of components supplied or work carried out is excluded.
9. The company shall not be liable for any loss or damage of any
description howsoever arising whether caused by the negligence of
the company its servants or agents or otherwise and whether arising
directly or indirectly out of the component parts supplied or workmanship
as is herein before expressly provided.
10. Prices are exclusive of V.A.T
11. Terms of trading- Strictly net monthly account.
12. This contract shall in all respects operate and be constructed
as an English contract and in conformity with English Law.
